Welcome to GTMRec.io. These Terms & Conditions (“Terms”) govern your access to and use of GTMRec.io’s recruitment and job board services across the European Union (EU). Our services include Outsourced Recruitment, Success Fee Recruitment, and Retainer-Based Recruitment Models. By accessing our website or engaging our services, you agree to be bound by these Terms, which are designed to comply with applicable EU employment, commercial, and data protection regulations.
1. Services Overview
GTMRec.io provides flexible and scalable recruitment solutions tailored to client hiring needs, including:
Outsourced Recruitment: Dedicated recruiters employed and managed by GTMRec.io.
Success Fee Model: Recruitment services with payment due upon a successful hire, subject to an upfront deposit.
Retainer Model: Subscription-based recruitment services provided over an agreed period.
The specific scope, fees, and timelines for each service will be outlined in a separate written agreement or proposal.
2. Outsourced Recruitment
Under the Outsourced Recruitment model:
GTMRec.io employs, manages, and oversees the recruiter(s) assigned to the client, including responsibility for payroll, benefits, compliance with EU labor laws, and HR administration.
Assigned recruiters may work closely with the client’s internal team and hiring managers, acting as an extension of the client’s recruitment function. However, all employment, contractual, and administrative obligations remain solely with GTMRec.io.
Clients agree to provide reasonable access, tools, information, and cooperation necessary for recruiters to perform their duties effectively.
3. Success Fee Recruitment Model
A 50% non-refundable deposit is required before recruitment activities commence.
GTMRec.io will use commercially reasonable efforts to identify and present suitable candidates; however, successful placement is not guaranteed.
The remaining balance becomes payable immediately upon the candidate’s written acceptance of an employment offer.
4. Retainer Recruitment Model
Retainer engagements require a minimum contract term of two (2) months, reflecting an average time-to-fill of approximately 45–60 days.
Retainer fees are payable monthly in advance and are non-refundable.
Clients must provide clear role descriptions, timely feedback, and all relevant documentation to enable efficient recruitment delivery.
5. General Terms Applicable to All Services
a. Payment Terms
Invoices are payable within 14 days of the invoice date unless otherwise agreed in writing.
Late payments may attract interest at a rate of 8% above the European Central Bank base rate, in accordance with the EU Late Payment Directive (2011/7/EU).
b. Confidentiality
Both parties agree to treat all proprietary business information, candidate data, and non-public materials as confidential.
Confidentiality obligations remain in effect during and after termination of the engagement.
c. Data Protection
GTMRec.io processes all personal data in compliance with the EU General Data Protection Regulation (GDPR).
Clients act as independent data controllers when handling candidate information and are responsible for their own GDPR compliance.
d. Non-Solicitation
Clients agree not to directly solicit, employ, or engage any GTMRec.io employees or recruiters during the term of the engagement and for 12 months thereafter, unless prior written consent is obtained.
e. Candidate Placement Guarantee
For Success Fee and Retainer Models, GTMRec.io offers a 30-day replacement guarantee if a placed candidate resigns voluntarily or is terminated for cause within that period.
f. Limitation of Liability
GTMRec.io shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its services.
Any direct liability is strictly limited to the fees paid by the client for the specific service giving rise to the claim.
g. Termination
Either party may terminate the agreement with 30 days’ written notice, except where a minimum term applies (such as under the Retainer Model).
Fees already paid remain non-refundable unless otherwise expressly stated in writing.
h. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union, with reference to applicable national laws in Ireland, the United Kingdom, Germany, Belgium, Spain, France, and the Netherlands.
6. Amendments and Modifications
GTMRec.io reserves the right to amend these Terms from time to time. Clients will be notified of any material changes in writing, with at least 30 days’ notice prior to the changes taking effect.
7. Dispute Resolution
The parties agree to first attempt to resolve any disputes amicably through good-faith negotiations.
If no resolution is reached, disputes shall fall under the exclusive jurisdiction of the competent courts in Amsterdam, Brussels, or Dublin, unless otherwise required by mandatory law.
