Services Overview<\/h2><p>GTMRec.io provides flexible and scalable recruitment solutions tailored to client hiring needs, including:<\/p><ul data-spread=\"false\"><li><p><strong>Outsourced Recruitment<\/strong>: Dedicated recruiters employed and managed by GTMRec.io.<\/p><\/li><li><p><strong>Success Fee Model<\/strong>: Recruitment services with payment due upon a successful hire, subject to an upfront deposit.<\/p><\/li><li><p><strong>Retainer Model<\/strong>: Subscription-based recruitment services provided over an agreed period.<\/p><\/li><\/ul><p>The specific scope, fees, and timelines for each service will be outlined in a separate written agreement or proposal.<\/p><h2>\u00a0<\/h2><h2>2. Outsourced Recruitment<\/h2><p>Under the Outsourced Recruitment model:<\/p><ul data-spread=\"false\"><li><p>GTMRec.io employs, manages, and oversees the recruiter(s) assigned to the client, including responsibility for payroll, benefits, compliance with EU labor laws, and HR administration.<\/p><\/li><li><p>Assigned recruiters may work closely with the client\u2019s internal team and hiring managers, acting as an extension of the client\u2019s recruitment function. However, all employment, contractual, and administrative obligations remain solely with GTMRec.io.<\/p><\/li><li><p>Clients agree to provide reasonable access, tools, information, and cooperation necessary for recruiters to perform their duties effectively.<\/p><\/li><\/ul><h2>\u00a0<\/h2><h2>3. Success Fee Recruitment Model<\/h2><ul data-spread=\"false\"><li><p>A <strong>50% non-refundable deposit<\/strong> is required before recruitment activities commence.<\/p><\/li><li><p>GTMRec.io will use commercially reasonable efforts to identify and present suitable candidates; however, successful placement is not guaranteed.<\/p><\/li><li><p>The remaining balance becomes payable immediately upon the candidate\u2019s written acceptance of an employment offer.<\/p><\/li><\/ul><h2>\u00a0<\/h2><h2>4. Retainer Recruitment Model<\/h2><ul data-spread=\"false\"><li><p>Retainer engagements require a <strong>minimum contract term of two (2) months<\/strong>, reflecting an average time-to-fill of approximately 45\u201360 days.<\/p><\/li><li><p>Retainer fees are payable <strong>monthly in advance<\/strong> and are non-refundable.<\/p><\/li><li><p>Clients must provide clear role descriptions, timely feedback, and all relevant documentation to enable efficient recruitment delivery.<\/p><\/li><\/ul><h2>\u00a0<\/h2><h2>5. General Terms Applicable to All Services<\/h2><h3>a. Payment Terms<\/h3><ul data-spread=\"false\"><li><p>Invoices are payable within <strong>14 days<\/strong> of the invoice date unless otherwise agreed in writing.<\/p><\/li><li><p>Late payments may attract interest at a rate of <strong>8% above the European Central Bank base rate<\/strong>, in accordance with the EU Late Payment Directive (2011\/7\/EU).<\/p><\/li><\/ul><h3>b. Confidentiality<\/h3><ul data-spread=\"false\"><li><p>Both parties agree to treat all proprietary business information, candidate data, and non-public materials as confidential.<\/p><\/li><li><p>Confidentiality obligations remain in effect during and after termination of the engagement.<\/p><\/li><\/ul><h3>c. Data Protection<\/h3><ul data-spread=\"false\"><li><p>GTMRec.io processes all personal data in compliance with the <strong>EU General Data Protection Regulation (GDPR)<\/strong>.<\/p><\/li><li><p>Clients act as independent data controllers when handling candidate information and are responsible for their own GDPR compliance.<\/p><\/li><\/ul><h3>d. Non-Solicitation<\/h3><ul data-spread=\"false\"><li><p>Clients agree not to directly solicit, employ, or engage any GTMRec.io employees or recruiters during the term of the engagement and for <strong>12 months thereafter<\/strong>, unless prior written consent is obtained.<\/p><\/li><\/ul><h3>e. Candidate Placement Guarantee<\/h3><ul data-spread=\"false\"><li><p>For Success Fee and Retainer Models, GTMRec.io offers a <strong>30-day replacement guarantee<\/strong> if a placed candidate resigns voluntarily or is terminated for cause within that period.<\/p><\/li><\/ul><h3>f. Limitation of Liability<\/h3><ul data-spread=\"false\"><li><p>GTMRec.io shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its services.<\/p><\/li><li><p>Any direct liability is strictly limited to the fees paid by the client for the specific service giving rise to the claim.<\/p><\/li><\/ul><h3>g. Termination<\/h3><ul data-spread=\"false\"><li><p>Either party may terminate the agreement with <strong>30 days\u2019 written notice<\/strong>, except where a minimum term applies (such as under the Retainer Model).<\/p><\/li><li><p>Fees already paid remain non-refundable unless otherwise expressly stated in writing.<\/p><\/li><\/ul><h3>h. Governing Law<\/h3><ul data-spread=\"false\"><li><p>These Terms are governed by and construed in accordance with the laws of the <strong>European Union<\/strong>, with reference to applicable national laws in <strong>Ireland, the United Kingdom, Germany, Belgium, Spain, France, and the Netherlands<\/strong>.<\/p><\/li><\/ul><h2>\u00a0<\/h2><h2>6. Amendments and Modifications<\/h2><p>GTMRec.io reserves the right to amend these Terms from time to time.
